Am I required to declare my diabetes to my car insurance?

Maine Libre reader Serge asks himself the following question:Am I required to declare my diabetes to my car insurance?»

First, it must be remembered that there are two types of diabetes. Type 1 diabetes (which occurs in children and young adults) is an autoimmune disease. More specifically, the body no longer produces insulin, a hormone secreted by the pancreas that allows the sugar in food to be redirected into the body to provide it with energy. People with type 1 diabetes are insulin dependent and inject themselves with insulin throughout the day and with meals.

Type 2 diabetes (which usually occurs in adulthood) is caused by a dysfunction of the pancreas, but milder. The body produces insulin, but in small amounts. It represents 90% of the cases of diabetes after 60 years.

When stable and well monitored, this disease does not cause complications in daily life. Driving is not prohibited. But in the long term, diabetes can cause problems with vision, mobility and the heart risk is higher. People with diabetes are also more prone to hypoglycemia (when there is not enough sugar in the blood), which can lead to discomfort that is not very reassuring while driving.

The declaration does not result in an increase in the price

This is why it is important and even mandatory to report your diabetes to a car insurance policy. Pursuant to Article L 113-2 of the Insurance Act, the insured must “answer accurately the questions asked by the insurance company, especially in the risk declaration form with which the insurance company asks him when the contract is concluded about the circumstances that may lead the insurance company to assess the risks he supports.“.

The official website for AJD (Help for Young Diabetics) also points out: “This applies both to accompanied driving and to unaccompanied driving.. »

When you declare your diabetes, there will be no premium increase or impact on the price and terms of the policy, but this avoids the risk of invalidity of the contract in case of non-declarationspecifies AJD’s website, unless the handicap generates an adaptation of the car“.

Consequences in case of incorrect information

If you have not declared your diabetes to the policy before a claim, “the insurance company has the right to either maintain the contract subject to a premium increase accepted by the insured or to terminate the contract ten days after notice sent to the insured per registered letter by returning the part of the premium paid for the time when the insurance no longer runs “.

In the event that the finding of an inaccurate statement only takes place after an injury, caused by hypoglycemic discomfort while driving, e.g.the compensation is reduced in proportion to the rate of the premiums paid in relation to the rate of the premiums that would have been due if the risks had been fully and accurately stated”, according to article L113-9 of the Insurance Act.
