Aggressive defense of copyright
House of Mario is particularly known for its aggressive defense of its copyrights. Over the years, Nintendo has issued numerous DMCA notices to remove content and has sued numerous websites and users for copyright or patent infringement. It is in this continuation that the company has published a job posting for a legal advisor for its intangible property group.
A possible increase in lawsuits
Details of the new job posting were shared by the Nintendodeal fan account on Twitter on October 14. The announcement states that Nintendo is seeking a member of the Washington State Bar with at least five years of experience to join the division dedicated to protecting its intellectual property. This includes handling copyright infringement cases for which the company is famous and protecting the company from any incoming legal disputes.
The new job offer comes on the heels of several intellectual property concerns for Big N. A multiplayer game Pokemon that have reportedly been leaked online have revealed a wealth of internal company resources, new and old. Furthermore, Nintendo has also had ongoing problems with the ever-growing emulation space. As emulators become more and more common, the creator of Mario has not relented in its efforts to try to take down the site that distributes ROMs of its games.
Nintendo’s Legal History
It is not yet clear whether the new intellectual property counsel position is linked to a plan to step up litigation amid growing concerns over emulation and leaks. This is not hard to imagine, however, given the company’s history of legal battles. Recently, Nintendo sued a modification company citing piracy laws. The company has even gone so far as to remove live streams and videos of its games in the past, calling them an illegal use of its trademarked material. While not all cases were resolved in Nintendo’s favor, many left little reason for the company to stop, other than its reputation with gamers.
The new position may also help handle larger litigation cases. In September, Nintendo filed a lawsuit against Palworld due to perceived similarities between the title and Pokemon. Hiring a new attorney could be one way to improve your position in this case. Regardless of the reason, the position remains open for now, so how Nintendo uses its expanded legal team remains to be seen.
