MAINTENANCE – The former Supreme Court judge explains how this institution, which is the foundation of American democracy, works.

Justice Stephen Breyer served 28 years on the Supreme Court. Composed of nine judges appointed for life, whose decisions are binding on all the States of the Union, the court has taken several controversial judgments in recent months, in particular revoking the constitutional guarantee of the right to abortion.

Retired since June 30, replaced by Ketanji Brown Jackson, Judge Breyer, a perfect French speaker, answers questions from the Figaro on the functioning of this unique institution. He is the author of several books (translated by Éditions Odile Jacob).

LE FIGARO. – How does the office of a Supreme Court judge differ from that of an ordinary judge?

Stephen Breyer. – The difference is less than is often imagined. When the text of the law is clear, the text is applied. But the text is never clear. And this is doubly true for the Supreme Court. Because we obviously only deal with cases where the judges of the courts have decided a question…
