Paris wants to grant residence permits to immigrants who have arrived in the country irregularly but agree to work in sectors “under pressure” such as construction, which currently has around 400,000 vacancies. According to the plan announced by the government to the press, which has not yet been finally approved, visa recipients will not be able to bring their families to France in the framework of family reunification, because this is only possible after “one year” of presence in French territory. The measure, which has been defined by the right as a “campaign to legalize illegal immigrants”, is part of the future law on asylum and immigration planned for the first half of 2023, which would introduce a series of measures to make ” obligations to leave French territory” (including the French abbreviation, Oqtf).

In Darmanin’s words, the Paris government wants a law that is “bad to the bad and kind to the good.” “We will propose the tacit renewal of multi-year titles for those who do not cause problems, who do not have a criminal record”, he continued, estimating that it is several hundreds of thousands of people. . At the same time, “we are going to register all the OQTFs in the wanted persons file” to “be able to ensure that he has actually left the territory and thus count all departures”, Darmanin explained to the Le Monde newspaper.

The bill also allows for the generalization of the single judge at the National Court for Right of Asylum (CNDA), where a panel will only meet for “very difficult cases”. Finally, the text provides that the refusal of an asylum application at first instance by Ofpra (the French Office for the Protection of Refugees and Stateless Persons) “will be considered an OQTF with the possibility of appeal within fifteen days”.
